Effective date: 05/07/2026

These Terms and Conditions govern the sale of original paintings and prints through this website. By placing an order, you agree to these terms. Please read them before making a purchase.

1. About Me

This website is operated by Julien Le Pocher, an independent artist trading as a sole trader in the United Kingdom ("I", "me", "my"). I am not registered for VAT, and no VAT is added to prices. You may contact me through the Contact page on this website.

2. The Products

Original paintings are unique, one-off works. As handmade objects, minor variations in surface, texture, and edges are inherent to each piece and are not defects.

Prints are open-edition reproductions, made to order and produced by a third-party print partner.

Product images are representative, and colours may vary slightly from those shown on your screen.

3. Prices and Payment

All prices are stated in pounds sterling (GBP). Prices may change from time to time, but a change will not affect an order already placed.
If you are shopping from outside the United Kingdom, any price shown in your local currency is indicative only. Payment is taken in pounds sterling (GBP), and your bank or card provider may apply its own exchange rate and charges.

Payment is taken in full at the point of checkout through the website's payment provider, and the accepted methods of payment are displayed at checkout.

For deliveries outside the United Kingdom, you may be liable for import duties, taxes, or customs charges, which are your responsibility and are not included in the purchase price.

4. Orders and Formation of Contract

The display of products on this website is an invitation to treat and not an offer, and your order constitutes an offer to purchase. A binding contract is formed only when I confirm acceptance of your order or dispatch the item, whichever occurs first. I reserve the right to decline or cancel an order, for example where an item is no longer available or where a genuine error in pricing or description has occurred. I may also decline or limit any order that appears to be placed by a dealer or reseller. Where I cancel an order for which payment has been taken, you will receive a full refund. Ownership of an item remains with me until I have received payment in full.

5. Delivery

Original paintings are packed with care and sent by a tracked and insured service, ordinarily within 5 working days of the order.

Prints are made to order, and additional production time should be allowed before dispatch.

Estimated delivery times are provided in good faith but are not guaranteed. Risk in the goods passes to you upon delivery.

International shipping costs

For orders outside the United Kingdom, shipping is charged at a flat rate based on the weight of your order. These rates are estimates. Original paintings are large and carefully packed, so the true cost of posting an order fully tracked and insured can sometimes come out higher than the rate shown at checkout.

If the actual cost of shipping your order is significantly higher than the amount charged at checkout, I will get in touch with you before your order is sent. We can then discuss the difference, and you are welcome to cover the additional shipping cost so the order can go ahead. If we cannot reach an agreement, or if it turns out your order cannot be shipped to your location in a safe and practical way, I reserve the right to decline the order and give you a full refund. Nothing in this section affects your statutory rights.

6. Cancellations and Returns

6.1 Right to cancel (change of mind). Under the Consumer Contracts Regulations 2013, you may cancel your order within 14 days of receiving the item, for any reason. To cancel, notify me through the Contact page within that 14-day period. You must then return the item within 14 days of notifying me, unused and in its original condition and packaging.

6.2 Refunds. I will refund the price of the item, together with the standard outbound delivery charge, within 14 days of receiving the returned item. Where you selected a premium delivery option, only the standard delivery cost will be refunded.

6.3 Original paintings. Originals must be returned using a tracked and insured service. You remain responsible for the item until it reaches me.

6.4 Prints. Prints are made to order and produced individually. Please allow 3 to 5 working days for production before dispatch. Your right to cancel under clause 6.1 applies from the day the print is delivered. Returned prints must be unused and in their original condition and packaging.

6.5 Return postage. Except where an item is faulty, damaged, or not as described, the cost of return postage is your responsibility.

6.6 Faulty or damaged items. If an item arrives damaged, faulty, or not as described, this is my responsibility under the Consumer Rights Act 2015. Notify me through the Contact page within 14 days, with photographs of the item and its packaging. I will arrange a repair, a replacement, or a full refund, including all delivery costs.

6.7 Reduction for diminished value. Where the value of a returned item has been reduced because it has been handled more than was necessary to establish its nature, characteristics, and condition, I may reduce the refund to reflect that reduction in value.

7. Commissions

From time to time I may accept a commission for a new work. A commission is agreed only once we have confirmed the subject, size, price, and an approximate timescale. A non-refundable deposit of 25% of the agreed price is payable before I begin, and the balance is due on completion, before dispatch. The deposit reflects the materials and the time reserved for your commission and is not returned if you cancel after work has started. I will share progress at agreed stages, and reasonable adjustments can be discussed at those points. A finished commission cannot be rejected on the basis of the natural, handmade character of an original painting. The intellectual property terms in clause 8 apply to commissioned work in the same way as to all other work.

8. Intellectual Property

I retain the copyright and all reproduction rights in every artwork and image displayed on this website. The purchase of an original painting or a print transfers ownership of the physical item only. It does not transfer any right to reproduce, adapt, resell as reproductions, or otherwise commercially exploit the work or its image. I retain the right to photograph, reproduce, and use images of any work, including works that have been sold, for promotion, portfolio, exhibition records, and the production of prints.

9. Limitation of Liability

Nothing in these terms excludes or limits my liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or your statutory rights as a consumer. Subject to the foregoing, my total liability arising out of or in connection with any order is limited to the price paid for the item concerned.

10. Consumer Rights

Nothing in these terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

11. Governing Law and Jurisdiction

These terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

I may amend these terms from time to time. The version published on this page at the time you place your order is the version that applies to that order. Last updated: 05/07/2026.

13. Contact

For any questions regarding these terms or your order, please contact me through the Contact page on this website.
